Personal Data Protection Notice (KVKK)

Prepared as data controller under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”). The Turkish text prevails in case of discrepancy.

1. Data controller

2. Data we process

  • Identity and contact data: name, surname, telephone, e-mail, preferred contact channel and language.
  • Enquiry data: search criteria (location, property type, budget range, timing), properties of interest, message content, referral information.
  • Owner data: title-deed, location and pricing information on represented properties and owner contact details.
  • Security and usage data: IP address, browser and device information, time of visit, preferences made on the site (language, theme, saved properties, cookie choice).
  • Cookie data (only with your explicit consent): visit statistics, ad interactions and online identifiers obtained through analytics and marketing cookies (see the Cookie Policy).
  • Correspondence: exchanges by telephone, e-mail or WhatsApp and meeting notes.

3. Purposes

  • Receiving, assessing and responding to acquisition, sale, rental and letting enquiries.
  • Providing brokerage and advisory services; conducting viewings, negotiation and closing.
  • Registering private-access briefs and contacting you when a suitable opportunity arises.
  • Meeting obligations under the Regulation on Real Estate Trade, the Turkish Commercial Code, the Tax Procedure Law and anti-money-laundering legislation.
  • Operating the site securely; measuring and improving service quality.
  • Where you have given explicit consent, measuring use of the site (Google Analytics) and measuring and targeting our advertising (Meta, Google Ads, LinkedIn).
  • Sending commercial electronic messages where you have given explicit consent.

4. Legal grounds

We rely on Article 5/2 KVKK: necessity for the establishment or performance of a contract (c), compliance with a legal obligation (ç), establishment, exercise or protection of a right (e) and our legitimate interests provided your fundamental rights are not harmed (f). Commercial electronic messages, analytics and marketing cookies and, where required, transfers abroad rely solely on your explicit consent (Articles 5/1 and 9).

5. Collection method

Data is collected by automated and non-automated means through the enquiry and private-access forms on this site, e-mail, telephone, WhatsApp, meetings, documents you provide and the technical infrastructure of the site.

6. Transfers

  • As required by the representation and limited to your request: property owners or prospective buyers/tenants, independent lawyers, notaries, valuation firms, banks and land registry offices.
  • Under legal obligation: competent public authorities.
  • For infrastructure: hosting, e-mail and information-security providers acting as data processors under contractual safeguards.
  • For international searches, with your explicit consent and within Article 9 KVKK: partner advisors abroad.
  • Where you give explicit consent in the cookie preferences, within Article 9 KVKK: Google (Google Ireland Limited, Google LLC), Meta (Meta Platforms Ireland Limited, Meta Platforms, Inc.) and LinkedIn (LinkedIn Ireland Unlimited Company, LinkedIn Corporation), including their servers abroad such as in the United States.

7. Retention

Personal data is retained for as long as the purpose requires and in any event until the end of the statutory periods (e.g. 10 years under the Commercial Code and Tax Procedure Law; 5 years for contracts and forms under the Regulation on Real Estate Trade), after which it is deleted, destroyed or anonymised. Private-access briefs are kept for a maximum of 2 years unless you instruct otherwise.

8. Your rights (Article 11 KVKK)

  • To learn whether your personal data is processed and to request information about it.
  • To learn the purpose of processing and whether data is used accordingly.
  • To know the third parties to whom data is transferred in Turkey or abroad.
  • To request rectification of incomplete or inaccurate data; erasure or destruction where the conditions for processing no longer exist; and notification of these operations to third-party recipients.
  • To object to a result arising against you from analysis exclusively by automated systems.
  • To claim compensation for damage caused by unlawful processing.

Applications are made through the channels described under “Data Subject Application” below and are concluded free of charge within 30 days at the latest.

Your application must include

  • Name, surname and, for written applications, signature.
  • Turkish ID number; for foreign nationals, nationality and passport number or ID number if any.
  • Residential or business address for service.
  • E-mail address, telephone or fax number for notification.
  • The subject of the request (a right under Article 11 KVKK).

Process

Applications are concluded free of charge as soon as possible and within 30 days at the latest. Where the operation entails an additional cost, the fee set by the Personal Data Protection Board may be charged. Applications on behalf of third parties require a notarised power of attorney.
